UC Berkeley officials are sure to feel the heat when Spanish prosecutors recommend criminal charges this week against Boalt law professor John Yoo and five other former Bush administration lawyers. Journalist Scott Horton, writing for the Daily Beast, said the recommendation could happen as early today, while the Associated Press reported that it is likely to occur sometime this week. Once prosecutors make the recommendation, it will be up to a Spanish investigating judge to file charges against Yoo and his colleagues. The Bush lawyers are under investigation for enabling torture in violation of international law. The question is: will the university keep saying Yoo is protected by academic freedom when a European country and US ally has issued a warrant for his arrest?
